Abstract

Appellant believes that as a matter of law the Court is bound by the Utah Rules of Civil Procedure specifically. Rule 8(d) Effect of failure to deny. Plaintiff failed to respond to the "Objection to Findings of Fact and Conclusions of Law/' see Exhibit A, subsequently admitting to deceiving tlie Defendant and committing fraud upon tlie court and admitting to be liable for postal errors. See Exhibit B. By admitting liability for postal errors, Plaintiff has claimed responsibility for court costs. Judge Ann Boy den has ignored this rule and awarded court costs to the Defendant Appellant. To best of Defendant Appellant's knowledge this is a case of first impression.
