THIS APPEAL IS FROM A JUDGMENT, SENTENCE AND COMMITMENT IN WHICH THE DEFENDANT PLED GUILTY TO THEFT BY RECEIVING STOLEN PROPERTY, A THIRD DEGREE FELONY, WHEREIN DEFENDANT WAS SENTENCED TO SERVE A TERM OF ZERO TO FIVE YEARS AT THE UTAH STATE PRISON, IN THE SECOND DISTRICT COURT FOR WEBER COUNTY, THE HONORABLE MICHAEL D. LYON PRESIDING.
