THIS APPEAL IS FROM A PLEA AND SUBSEQUENT SENTENCING TO DISTRIBUTING A CONTROLLED SUBSTANCE, A SECOND DEGREE FELONY AND ATTEMPTED POSSESSION OF A CONTROLLED SUBSTANCE A CLASS A MISDEMEANOR AND WAS SENTENCED TO SERVE A TERM OF ONE TO FIFTEEN YEAR AT THE UTAH STATE PRISON AND THREE HUNDRED AND SIXTY-FIVE DAYS, CONSECUTIVELY, IN THE SECOND JUDICIAL DISTRICT COURT IN AND FOR WEBER COUNTY, STATE OF UTAH, THE HONORABLE ERNIE W. JONES PRESIDING. DEFENDANT/APPELLANT IS CURRENTLY INCARCERATED AT THE UTAH STATE PRISON.
