Pursuant to Rule 24 (i) of the Utah Rules of Appellate Procedure, I wish to advise the Court of a pertinent submission which was not available when I filed my Response to Petition for Writ of Certiorari. Attached is the August 23, 1995, Statement of Brent Johnson on Behalf of the Court of Appeals. This statement of Mr. Johnson was submitted in Case No. 950298 (the Josephsons' Petition for Extraordinary Writ), and it bears upon the jurisdictional and procedural issues herein as well. Reference is made to page 5 of the undersigned's Response to Petition for Writ of Certiorari.
