Abstract
This appeal is from a judgment and conviction against Nancy Wardle Martinez for Theft by Receiving, a felony in the third degree, in violation of Utah Code Ann. §76-6-408 (1953 as amended). The appellant was charged with Theft by Receiving, a second degree felony, and was found guilty by a jury of the lesser included offense of Theft by Receiving, a third degree felony, on May 22, 1987, in the Third Judicial District Court, in and for Salt Lake County, State of Utah, the Honorable Richard H. Moffat, Judge, presiding. Ms. Martinez was sentenced by the Honorable Richard H. Moffat, Judge, on May 22, 1987, to a term of zero to five years at the Utah State Prison, which sentence was stayed and appellant placed on probation for eighteen months.
