Abstract
This appeal is from a final order and judgment finding Appellant guilty of one count of retail theft, a third degree felony, and sentencing Appellant to a term of Zero (0) to five (5) years at the Utah State Prison. This Court has jurisdiction pursuant to Utah Code Ann. Section 78-2-2(3)(i). Appellant's conviction was entered by Judge Pamela G. Heffernan on July 15, 1998. On March 23, 1999 the Defendant was Re-Sentenced on the same charge and ordered to serve a term not to exceed 5 years at the Utah State Prison to run consecutive with the other sentences being served.
