Abstract
BRIEF OF APPELLANT THIS APPEAL IS FROM THE DENIAL OF A MOTION TO SUPPRESS, A SERY PLEA RESERVING THE RIGHT TO APPEAL THE DENIAL OF THE MOTION TO SUPPRESS, AND SENTENCING TO POSSESSION OF A CONTROLLED SUBSTANCE WITH THE INTENT TO DISTRIBUTE, A THIRD DEGREE FELONY. THE DEFENDANT WAS SENTENCED TO A STAYED PRISON SENTENCE OF ZERO TO FIVE YEARS IN THE STATE PRISON, 120 DAYS IN THE SUMMIT COUNTY JAIL IMPOSED BUT STAYED PENDING THIS APPEAL, IN THE THIRD DISTRICT COURT IN AND FOR SUMMIT COUNTY, STATE OF UTAH, THE HONORABLE BRUCE C. LUBECK PRESIDING. THE APPELLANT IS CURRENTLY NOT INCARCERATED.
