THIS APPEAL IS FROM A CONVICTION AND SUBSEQUENT SENTENCING TO ONE COUNT OF ILLEGAL POSSESSION OR USE OF A CONTROLLED SUBSTANCE, A THIRD-DEGREE FELONY, AND ONE COUNT OF POSSESSION OF DRUG PARAPHERNALIA, A CLASS B MISDEMEANOR AND WAS SENTENCED TO SERVE CONCURRENT TERMS OF NOT LESS THAN FIVE YEARS AND WHICH MAY BE FOR LIFE AT THE UTAH STATE PRISON, IN THE SECOND JUDICIAL DISTRICT COURT IN AND FOR WEBER COUNTY, STATE OF UTAH, THE HONORABLE PAMELA G. HEFFERNAN PRESIDING. THE DEFENDANT/APPELLANT IS CURRENTLY INCARCERATED AT THE UTAH STATE PRISON.
