Abstract
THIS APPEAL IS FROM A CONVICTION AND SUBSEQUENT SENTENCING TO POSSESSION OF A CONTROLLED SUBSTANCE, A THIRD DEGREE FELONY; AND WAS SENTENCED TO SERVE AN INDETERMINATE TERM OF NOT TO EXCEED FIVE YEARS IN THE UTAH STATE PRISON, WHICH WAS SUSPENDED. DEFENDANT WAS PLACED ON PROBATION WITH A JAIL TERM OF 30 DAYS. THIS MATTER WAS DOCKETED IN THE SECOND JUDICIAL DISTRICT COURT TN AND FOR WEBER COUNTY, STATE OF UTAH, THE HONORABLE MICHAEL D. LYON PRESIDING.
