Abstract
This is an appeal from the judgment, sentence, order staying execution of sentence and th order of probation entered the 27 day of January, 2010, resulting from a judgment by the court at bench trial where the Appellant was found guilty of tampering with a witness, a third degree felony, in violation of Utah Code Annotated, Section 76-8-508(1) and assault, a class A misdemeanor, in violation of Utah Code Annotated, Section 76-5-102 (1953, as amended). The trial took place in Beaver County, State of Utah, the Honorable G. Michael Westfall presiding. The Appellant is presently serving the sentence but not incarcerated
