RESPONSE TO CROSS-PETITION AND REPLY BRIEF OF PETITIONER This case is here for a review of the Utah Court of Appeals' decision affirming Appellant Jeffery Russell Finlayson's sentence for one count of rape, a first degree felony in violation of Utah Code Ann. § 76-5-402 (1999), and one count of forcible sodomy, a first degree felony in violation of Utah Code Ann. § 7(» V40 M ?) (1999).
